TERMS OF USE – for doctors using the sDoktor web application

 

1. Introduction
These Terms of Use define the rules under which doctors (“Doctor”) use the sDoktor web application (“Application”), accessed through the official login address assigned by SKVID d.o.o. (“SKVID”).
The Application is provided by: SKVID d.o.o., Jalševečka cesta 40, 10040 Zagreb, Croatia. OIB: 27197549120.
The Application is a software tool designed for secure, two-way digital communication between Doctors and their Patients, enabling the exchange of information and content.
By using the Application, the Doctor confirms that they have read, understood, and accepted these Terms of Use. The Application cannot be used without accepting these Terms.

2. Definitions
For the purpose of these Terms:

  • Doctor – a licensed healthcare professional, regardless of employment status (health centre, hospital, private practice, concession, or other).
  • Patient – an individual using the sDoktor mobile app to communicate with their Doctor.
  • Practice / Clinic – the healthcare institution or organisation where the Doctor provides services.
  • SKVID – the provider of technical infrastructure and owner of the Application; SKVID has no access to the content exchanged between Doctor and Patient.

3. Purpose of the ApplicationThe Application enables:

  • secure two-way communication between Doctor and Patients,
  • reviewing and responding to Patient messages,
  • exchanging information through an encrypted communication channel.

The Application is not:

  • a certified medical information system,
  • a source of medical advice (which is provided exclusively by the Doctor),
  • a medical device or medical product under applicable regulations.

The Doctor is solely responsible for all medical information, decisions, and communication.

4. Registration and Access
The Doctor accesses the Application using a personal user account and login credentials.
The Doctor agrees to:

  • use only their own user account,
  • keep login credentials secure (username and password),
  • not share one-time security codes with third parties (SMS codes or email confirmations),
  • not share access with persons who are not authorised by the healthcare institution (nurses, administrative staff),
  • immediately notify SKVID of any suspected unauthorised access.

The Doctor / healthcare institution is solely responsible for internal access permissions.
The Doctor is responsible for all actions performed under their account.

5. Role and Responsibility of SKVID
SKVID acts exclusively as a technical service provider and:

  • does not access or process communication content between Doctor and Patient,
  • does not review messages, attachments, or documents,
  • does not provide medical advice,
  • is not responsible for medical decisions, diagnoses, or procedures,
  • does not assume obligations of the healthcare institution.

SKVID ensures:

  • system stability,
  • security infrastructure,
  • encryption of communication,
  • technical support and system maintenance.

6. Role and Responsibility of the Doctor
The Doctor acknowledges that they:

  • are the data controller for information exchanged with Patients,
  • independently determine the purpose and means of processing Patient information,
  • are fully responsible for the content of communication,
  • must comply with applicable regulations for data protection and healthcare documentation,
  • must not allow unauthorised persons to access Patient information.

The Application does not replace:

  • the medical record,
  • the official healthcare information system,
  • legally required documentation.

7. Privacy and Security
SKVID:

  • does not collect Patient medical information,
  • has no access to message content or attachments,
  • processes only technical data necessary to operate the system (without access to Patient information),
  • does not share data with third parties.

8. Rules of Use
The Doctor is prohibited from:

  • using the Application unlawfully,
  • submitting incorrect or misleading information,
  • compromising system security,
  • attempting to disrupt service operation,
  • sharing login data with others,
  • transmitting unlawful or confidential content.

SKVID may temporarily or permanently restrict access in cases of misuse.

9. Service Availability
SKVID makes reasonable efforts to ensure uninterrupted service but:

  • does not guarantee availability during technical issues, maintenance, failures, or force majeure,
  • is not responsible for interruptions caused by third-party networks, internet providers, or the Doctor’s device.

10. Intellectual Property
All parts of the Application (software, code, design, graphics, text) are the exclusive property of SKVID.
The Doctor may not:

  • modify,
  • copy,
  • distribute,
  • adapt,
  • reverse-engineer or attempt to reconstruct the Application.

11. Changes to Terms
SKVID may update these Terms periodically.
The updated version will be published within the Application and on the official website. Continued use constitutes acceptance of the changes.

12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Croatia.
Any disputes shall be resolved before the competent court in Zagreb.
